JUST THE FACTS:
Employee arrived for work and had entered upon premises owned or controlled by the Employer when she slipped on a wet curb surrounding a planting, lost her balance and fell to the ground sustaining injury.
Employee sustained fracture injury to her left ankle. She was treated in the Emergency Room and by an Occupational Medicine Specialist who presented medication, X-rays, MRIs, and a brace.
Employer and Insurer paid approximately $108.49 in medical expenses, $539.06 in Temporary Total Disability (sick pay) and 15% Permanent Partial Disability was assessed to the ankle, equivalent to $15,500.00. Second Injury Fund benefits eligibility for alleged Permanent Partial Disability.
Attorney fees: 25% contingency of $15,500.00 plus payment of out-of-pocket expenses of $352.63.
