JUST THE FACTS:
Employee, while acting within the course and scope of her employment, was stepping out of a carpet bathroom onto a vinyl floor when she slipped and fell sustaining injury.
Employee sustained injury to her right leg and ankle as well as her back. She was treated by Primary Care Physician and Occupational Medicine Specialists who presented medication, X-rays, MRI, various testing, surgery, and physical therapy.
Employer and Insurer paid approximately $48,600.00 in medical expenses and $8,250.00 in Temporary Total Disability (sick pay). Permanent Partial Disability was assessed to the right ankle and to the body as a whole attributed to the low back equivalent to $16,626.54 with additional payment of $60,000.00 for Second Injury Fund benefits for alleged Permanent Partial Disability.
Attorney fees: 25% contingency of ($16,626.54 + $60,000.00) plus payment of out of pocket expenses of $1,918.99.
